Beijing Home Care Services Ordinance

"Beijing Home Care Services Ordinance" has been adopted by the third session of the fourteenth session of the people's Congress of Beijing, and is hereby promulgated and shall be implemented as of May 1, 2015.
Article 1 in order to meet the social service needs of the elderly living in, to improve the quality of life of older persons, according to "the people's Republic of elderly rights and interests protection law" and other relevant laws and regulations, combined with the actual circumstances of this Municipality, the enactment of this Ordinance.
& nbsp; & nbsp; & nbsp; the second article of this Ordinance referred to in home care service refers to the family as the foundation, in under the guidance of the government, in urban and rural communities rely on, to the social security system as the support, by the government provides basic public services, enterprises and social organizations to provide professional services, grass-roots mass self-government organizations and volunteer public assistance services, to meet the living in the home for the elderly socialized service demand of pension service model.
& nbsp; & nbsp; & nbsp; the three home care service should to live in the home for the elderly service demand oriented, adhere to the voluntary choice, the nearest convenient, safe, high quality and reasonable price principle. Home care services mainly include the following:
      (a) for the elderly to provide a community aged dining table, catering, catering, open unit canteen and other dining services;
      (two) to provide medical care, medical, nursing, rehabilitation and other health services for the aged;
      (three) providing home care services for disabled elderly;
    (four) providing emergency rescue services for the disabled, elderly, elderly people living alone;
      (five) the community daycare center and other facilities to provide day care services for the elderly;
      (six) for the elderly to provide home cleaning, help bath, assisted travel and other domestic services;
      (seven) providing care for people living alone, elderly people with care, life, psychological counseling, adverse emotional intervention and other spiritual comfort services;
      (eight) to carry out cultural recreation and sports for the elderly people's physical and mental health.
& nbsp; & nbsp; & nbsp; the children of the elderly and other obligated to support and assist, support obligations shall fulfill the elderly economic support, life care and spiritual solace obligations. Need to provide services by the community, the elderly family based on the nature and quantity of services, and bear the corresponding costs.
      fifth city and district and County People's governments shall perform the following duties in the home care service:
      (a) will be incorporated into the national economic and social development planning and annual plan for the aged;
      (two) the financial budget of the aged is included in the financial budget, and the establishment of the old population growth and the economic and social development level;
      (three) improve the social security system related to the home care system;
      (four) the overall planning, the standard configuration of community care facilities;
    (five) the cultivation of pension services industry, improve support policies to guide and encourage enterprises and social organizations to carry out home care services;
      (six) the development of service standards and standards, strengthen the supervision of the pension services market and information network construction;
& nbsp; & nbsp; and (7) to strengthen the coordination of home care services, and clear the relevant departments of the duties, tasks, deadlines, improve working mechanism, strengthen supervision and inspection and performance evaluation. Old age at all levels should organize, coordinate and guide, supervise and urge the relevant departments to implement the work of home care services.
    Sixth Township People's governments and neighborhood offices responsible for the implementation of the following home care services for the following:

& nbsp; & nbsp; & nbsp; and (IV) support, guide social forces to improve the community service network, the use of the network information service platform to carry out emergency call, health consultation, purchasing goods, payment services etc. for the elderly;
      (five) the implementation of community elderly and volunteer registration system, explore the establishment of the elderly volunteer service time savings and incentive mechanism.
    seventh residents committee, the villagers committee shall play the function of democratic autonomy, the organization of the elderly and other residents of the community to carry out the following activities:
    (a) to carry out voluntary registration of residents' information, to understand and reflect the service needs of the elderly;
& nbsp; & nbsp; (II) to assist the government to the enterprise and social organization and management and operation of community care facilities and other services to supervision, appraisal, reflect the residents to improve home care services for the opinions and suggestions to the government;
    (three) the organization to carry out mutual aid pension, volunteer service and support the young elderly elderly activities;
      (four) the organization for the elderly to carry out cultural and recreational, sports activities.
      eighth municipal and district and County People's governments shall guide, support, encourage enterprises and social organizations to participate in home care services.
& nbsp; & nbsp; county civil affairs departments or responsible for aging mechanism can according to the needs of the development of home care services, through the signing of the contract, the purchase of services so as to determine the service providers and service units.
      business and social organizations engaged in home care services can be used by the government to provide facilities and places, but also to build their own pension facilities.
& nbsp; & nbsp; in the home pension service enterprises and social organizations enjoy policy support given by the government, and shall executive government services specifications, standards, subject to government guidance and social supervision.
    Ninth to encourage pension institutions to use their own resources to provide services for the elderly living in the surrounding community.
& nbsp; & nbsp; the tenth of the city and the district and County People's governments shall be in accordance with the actual needs of the elderly, in the urban and rural community configuration daycare and older activity station. & nbsp; & nbsp; & nbsp; Article 11 the municipal, district and County People's government should integrate social resources, and formulate policies to encourage and guide the enterprises, institutions and individuals will be living near idle venues and facilities, to carry out the old-age home service; guide the organs, organizations, enterprises and institutions open belongs places to provide services for the elderly in communities near; to guide the rural areas relying on administrative village, a natural village, the farmyard etc. areas, construction of daycare, elderly activity stations and other facilities for the elderly, to carry out the old-age home service.
    twelfth new construction, renovation and expansion of residential areas should be in line with the national standards for the construction of barrier free facilities.
Planning, housing and urban and rural construction and other departments should gradually promote the old district of the ramp, stair rails, elevators, and other daily life closely related to the life of the elderly service facilities.

& nbsp; & nbsp; Article 15 city human social security, health meter health and other departments should improve the basic medical insurance community drug reimbursement policy, according to the service function of community health service institutions improve the basic drug system, to ensure drug of community health service institutions equipped to provide convenience for the elderly in the community treatment of common diseases and chronic disease treatment.

& nbsp; & nbsp; Article 18 of the city should promote the pension service personnel professionalization, specialization, training with professional quality, professional knowledge and skills of the home care service workers. The municipal, district and County People's governments shall the service for the aged talent team construction into the education and training of human resources planning, promote the Pension Service Vocational Education and improve the pension service professional talent evaluation and incentive mechanism. Engaged in pension service enterprises and social organizations should absorb professional talent, and to engage in the pension service staff training.
Nineteenth city and district and County People's government should be the implementation of home care services for the implementation of the supervision and the annual target responsibility system assessment, and establish a system of accountability. The city people's governments at all levels and relevant departments staff violation of the provisions of this Ordinance, in home care public service activities does not perform, law to perform or improper fulfillment of duties, leading to the elderly people's legitimate rights and interests, public interests are damaged or causing serious consequences, according to the Beijing Municipal administration asked the responsibility "accountability, in violation of the provisions of the relevant laws and regulations shall bear the responsibility of discipline, in accordance with the Punishment Ordinance for civil servants working in administrative organs shall be punished; constitutes a crime, shall be investigated for criminal responsibility.
& nbsp; & nbsp; & nbsp; Article 20 community care facility managers, users without changing the government funded the construction of investment or, configuration of pension facilities functions and purposes, the civil affairs department shall order it to make corrections within a time limit, and shall be ordered to make restitution of subsidies and other related expenses can be fined 10 million yuan to 100 million yuan; overdue correction, call in administrative power, the right to use.
& nbsp; & nbsp; & nbsp; Article 21 enjoy government subsidies or preferential policies of pension services for enterprises, institutions and social organizations did not fulfill corresponding obligations of, by issuing sector subsidies back subsidies, cancel qualification for enjoying the preferential, and credited to the credit information system.
      twenty-second of these Regulations shall come into effect as of May 1, 2015.
